Copy Right and Page index problem

I am running a blog and some time earlier i was getting good visitor but some spammer made copied of my whole blog and make a new blog which results in loss of my web traffice.
Secondly my pages are not being indexed by the google
please help me how to get rid of this problem

Write a new unique content for your blog and post it. posting link submit on webmaster tool that will help to indexing your blog. After indexing your blog if some one copied your content that would be harmful for him not you.

just wait, google will penalize them
