I see a lot of proxy sites for sale at webmaster forums like sitepoint and digitalpoint and I've began to plan to start my own proxy surfing site. The main problem I see is that someone will use your proxy for evil stuff and you (the domain name owner) will get into trouble. Do you simply start a separate company to own the proxy site, use domain-by-proxy (or any other whois proxy service) or do you simply use something else to stay away from problems?

you're a little late
most of the sales happen because it's quiet these days in proxy land ...
if you accept problems because of the law in your country (and you care about that) it's better to not have any proxy service...

In your position I would get a different server/hosting account for my proxy business. The problem is not the law always, but usually you can lose your server and get your sites down.
That's the reason I stoped because I didn't want my hosting provider shut down my server
